| JobDesc | The Contracts Manager is responsible for the provision of contractual and commercial expertise as support to the Sales & Marketing and Tendering Departments The Contracts Manager will be fully familiar with all The Company’s standard Contracting Principles and their application. In participating in tendering activities, the Contracts Manager will form part of the tendering teams, assigned to the tenders, reporting to the Tender Project managers. Participation in preparation and negotiation of Client Framework Agreements as required, Maintenance and issuance of Contracting Principles Achievement Chart, Such other tasks as may be requested. Co-ordination of legal, contracts, insurance, commercial*, financial, risk management and tax input to tenders including, where necessary, JV’s and consortium arrangements, Plan, prepare and present regular Contract Awareness training sessions to all Sales, Marketing and Tendering Department personnel including “lessons learned” examples, Identification of “flow down” requirements both at Main Contract Tender stage and at subcontract and purchase order stage after main contract award with conjunction with the SCM Contracts Manager/Engineer. Contractual and commercial* overview of tenders prior to submission, Co-ordination with Global Account and Sales & Marketing Mangers with regard to specific tenders, Participate in Tender Board Reviews, weekly tender and Coorbid meetings, Participation in tender negotiations with prospective clients, Support for other regional contractual activities as requested, Review and qualify contract exhibits for tenders, Advise on alternative contractual position and contracting strategy to be considered in respect of tendering activities, Ownership of “lessons learned” feedback from Clients, PMT’s and subcontractor and suppliers including disseminating to all Sales, Marketing and Tendering department personnel, regional management and other departments, Participation in the contractual negotiations for Framework agreements, Monitor and audit good practices and deficiencies, related to contractual issues, within Sales, Marketing and Tendering Department processes including following up on corrective actions (where necessary) and promoting continuous improvement culture, Sign off Tender Summaries. Qualification as a “QS” or as a lawyer, engineer or economist/business manager; in all cases with the addition of 5 – 10 years relevant offshore construction experience. For non-QS or non-lawyers – Documented formal training in contractual and relevant legal topics under English or French/common law or a civil law jurisdiction. |
